A family who tragically lost three members in a fatal wrong-way collision on Highway 401 last year has initiated legal action against the officers, police board, and the estate of the deceased suspect involved in the crash.
Gokulnath Manivannan and his spouse Ashwitha Jawahar were the only survivors of the April 2024 incident that claimed the lives of Manivannan’s parents and their three-month-old child.
The lawsuit, seeking $25 million in compensation, alleges that negligence by the defendants, including two officers, Durham Regional Police, Ontario Provincial Police, and the suspect’s estate, led to the accident and subsequent injuries.
The collision occurred on April 29, 2024, following a police pursuit stemming from an alleged liquor store robbery in Bowmanville, Ont. The pursuit led to the suspect driving in the wrong direction on Highway 401 in Whitby, resulting in a multi-vehicle collision that claimed multiple lives, including the suspect.
Sgt. Richard Flynn and Const. Brandon Hamilton of the Durham police are facing charges related to the collision after an investigation by the Special Investigations Unit (SIU).
The family’s claim asserts that the suspect showed blatant disregard for their safety, while the officers’ decision to engage in the pursuit on the highway without considering alternatives was reckless and led to fatalities and injuries.
The family accuses Durham police of inadequate training for officers in pursuit situations and failing to terminate the chase when necessary.
The family continues to endure significant physical and emotional suffering from the crash, incurring ongoing medical expenses and loss of income due to sustained injuries and impairments.
Legal representation for the family, Brad Moscato and Adam Wagman from Howie, Sacks & Henry LLP, stated that they are committed to conducting a thorough investigation to uncover the circumstances surrounding the incident.
The family hopes that the tragic event prompts a review of pursuit authorization protocols to prioritize public safety and prevent similar incidents in the future.
