The Pentagon is currently looking into Democratic Senator Mark Kelly from Arizona for potential violations of military regulations following his participation in a video urging U.S. troops to reject illegal commands. The Pentagon’s announcement, shared on social media, referenced a federal law that permits retired military personnel to be called back to active duty by the defense secretary for potential legal action. Kelly, a former U.S. navy fighter pilot and astronaut, retired as a captain.

The Pentagon’s move to investigate a sitting member of Congress is highly unusual and contrasts with its usual nonpartisan stance prior to President Donald Trump’s second term. The statement from the Pentagon suggested that Kelly’s remarks in the video could have a negative impact on the loyalty and discipline of the armed forces, citing regulations that prohibit such behavior.

Kelly responded by affirming his commitment to the Constitution and dismissing the Pentagon’s inquiry as an act of intimidation. He stated that such tactics would not deter him or other lawmakers from holding the administration accountable. In the video, Kelly and other lawmakers emphasized the importance of standing up for laws and the Constitution, encouraging military personnel to refuse illegal orders.

Defense Secretary Pete criticized Kelly’s actions, stating that they bring dishonor to the military and will be addressed accordingly. The broader group of lawmakers featured in the video was also criticized for causing confusion and endangering military personnel. Although the video did not specify particular incidents, its release coincided with the administration’s directives to destroy small boats involved in drug trafficking and deploy National Guard troops to U.S. cities despite legal challenges.

Chief Pentagon spokesperson Sean Parnell reiterated the importance of military adherence to legal orders. Senate Democrats, including Minority Leader Chuck Schumer, defended Kelly and accused Trump of politicizing the Pentagon.

According to constitutional law expert Anthony Michael Kreis, Kelly’s status as a senator could complicate the investigation due to constitutional protections for members of Congress. Military personnel, particularly commanders, are obligated to refuse unlawful orders, with legal advisors available for consultation.
