“Widow Sues Mother-in-Law Over Trust Fund Access”

The late Malcolm-Jamal Warner’s widow, known for his role on The Cosby Show as a young actor in the 1980s, has initiated legal action against his mother over access to his trust fund.

On Monday, Tenisha Warner filed a lawsuit seeking over $1.2 million US from Pamela Warner, who manages the trust, in DeKalb County Superior Court in Decatur, Georgia, where the family resided. The legal action coincided with the first anniversary of Malcolm-Jamal Warner’s passing.

The actor was 54 when he tragically drowned in Costa Rica on July 20, 2025, while vacationing with his family. He was widely recognized for his portrayal of Theo Huxtable on The Cosby Show from 1984 to 1992.

In a statement conveyed by her legal representatives to CBC News, Tenisha Warner expressed her efforts to privately settle her late spouse’s intricate estate, respecting his final wishes regarding their daughter, MacKenzie.

“Malcolm had every intention of providing for our nine-year-old daughter and me,” the statement affirmed.

“As a single mother struggling to support our daughter, I had no option but to safeguard our rights before any potential legal time limits expired.”

Trust Fund Dispute

Tenisha Warner’s petition outlines that the trust established in 1996, predating her relationship with Malcolm-Jamal Warner and prior to their daughter’s birth, designates the entire trust estate to other family members, primarily Pamela Warner, alongside his father and half-sister.

Legal documents assert that monies from life insurance policies and retirement accounts have already been disbursed to these beneficiaries, totaling over $1.25 million US.

The filing alleges that Warner left numerous financial commitments unmet towards his wife and daughter before his demise. Tenisha Warner is pursuing at least $1,276,042.46 US, excluding interest, legal fees, and expenses. She seeks court validation as an omitted heir and spouse, a temporary halt on trust distributions, and a comprehensive financial report.

These purported obligations include:

  • $1,000,000 US from a life insurance policy with Tenisha as the sole beneficiary.
  • $50,542.46 US tied to an annual anniversary gift provision of $16,000 US per year.
  • $30,500 US for Roth IRA contributions at the maximum stipulated level.
  • $195,000 US for monthly salary obligations of $5,000 US for Tenisha’s role as “chief of staff.”

The petition also mentions a prenuptial agreement mandating the establishment of a college fund for their daughter.

Pamela Warner’s Commemoration

On the first anniversary of her son’s passing, Pamela Warner shared a tribute on his memorial Instagram account, reflecting on a year of personal growth amidst pain and loss.

“It’s surreal to be here without my child,” she expressed.

Her post urged individuals to cherish loved ones and resolve conflicts, advocating for a positive cleanse of the spirit.

CBC News reached out to Pamela Warner’s representatives for comments on the lawsuit but received no response prior to publication.

The legal proceedings are set for hearings on September 23 and October 1 in Los Angeles.
