Weinstein’s spokesperson expressed disappointment with the court’s decision, citing disagreement with the fairness of the trial but acknowledging the need for a new sentence. This decision followed prosecutors in New York dropping charges against Weinstein, indicating he would not face a fourth trial due to the accuser’s reluctance to testify again.
The California panel ordered resentencing due to the consideration of now-dismissed New York convictions as aggravating factors in the initial sentencing. Weinstein, aged 74, is still convicted of another sexual felony in New York and awaits sentencing there in September, with prosecutors seeking a 20-year prison term.
In California, Weinstein was convicted in December 2022 for raping an Italian model and actor known as Jane Doe 1. Following the trial, Jane Doe 1, identified as Evgeniya Chernyshova, publicly accused Weinstein in civil court. Testifying against Weinstein, Chernyshova detailed an assault during the 2013 LA Italia Film Festival.
Weinstein’s defense had argued for a new trial, claiming that crucial evidence was excluded during the initial proceedings. However, the appeals court maintained that Weinstein was given a fair trial, with no denial of his defense rights. Additionally, the court upheld the admissibility of testimony from accusers describing Weinstein’s uncharged sexual assaults.
Weinstein, maintaining his innocence, faces ongoing legal battles as his team plans to seek further review in the California Supreme Court. The Los Angeles County District Attorney’s Office refrained from commenting on the decision immediately, and Chernyshova’s attorney did not respond to requests for comment.
